This gathering was hosted by Ali Biju at his own longhouse,Rumah Chandi, Nanga Budu, Saratok on 1st January, 2011. Estimated crowd is 1,000 but actually there is many more who had failed to turn out for the gathering due to logistic problems.There were speaker at every bilik’s ruai. Judging by the turn out,this show that Pakatan Rakyat is getting more and more supports from the peoples of N.34 Krian.Beware and be ready Peter Nyaruk!! You’re going to get a TOUGH Battle!!

Blockade by anembiaks from Rumah Ranggong and Rumah Belili,Ulu Niah

 

This morning representatives from Rumah Ranggong and Rumah Belili, Ulu Niah erected a blockade against Niamas Istimewa Sdn. Bhd., a JV company involving BLD and SLDB which renegade on their promise to develop NCR land of the natives in Ulu Niah under Konsep Baru

The natives have actually taken the company to court-with coming hearing dated on Jan 24th 2011. They decided to set up the blockade because the proceeding in the court is too slow. The company has taken the land and sold to another one later-the Niamas Istimewa Sdn Bhd. There is oil palm planted on the land for years but the natives are not getting their dues under the Konsep Baru joint-ventures because the company keep claiming that they have not started to make profit. This is a common occurrence which give a bad name to the Konsep Baru schemes where the natives are given 30% equity in the joint venture operation. Many natives who operate their own oil palm plantations tend to see better return from their land than these joint-ventures

Their NCR lands has been developed based on the same “Konsep Baru” with SLDB and Bintulu Lumber Development Sdn. Bhd. through their JV company, Niamas Istimewa Sdn. Bhd. in 1999 but was abruptly terminated in 2008 or after 9 years allegedly on the ground that there was no NCR over the land involved in the said project is one of such cases.The JV project was also officially launched by Tan Sri Alfred Jabu in 2001

On 4th December 2008, they have organised a protest with more than 220 people in front of the Kuching High Court holding up placards, the group of about 100 expressed anger over the failure of a plantation company to honour its promises to them.

They had signed a joint venture in 1997 with KTS Group subsidiary Niamas Istimewa Sdn Bhd and Sarawak Land Development Board, a statutory body and a shareholder of Sarawak Plantations Bhd, to develop 2,508 hectares of NCR land for oil palm.

Under the Konsep Baru land development scheme, the landowners would hold 30 percent of the equity, the government agency 10 percent and a private investor 60 percent.

Niamas Istimewa Sdn Bhd had made an initial payment of 10 percent of the agreed sum.

However, they has not paid a single cent of the 30 percent by way of unit trust shares to the landowners over the last 13 years, even though the harvested oil palm has brought returns to the joint-venture (JV) company.

The landowners have also learned that 10 percent of the equity of the JV company has since been sold to the private investor without their knowledge.They had asked Deputy Chief Minister Alfred Jabu and State Land Development Minister James Masing to intercede for them, but that there has been no result.

An unhappy new fear for Sarawak’s old guard
 
Sarawak’s political elite have accumulated power and startling wealth by taking over land from native communities, but now face the prospect of setbacks in the new year.

The entrenched ‘old guard’, accustomed to holding undisputed control over public life, may be struck by a triple whammy.

Firstly, the courts have overturned several ministerial decisions to award land to crony companies. Land minister James Masing has branded critics of Sarawak’s land policies as “arrogant and ignorant”, but judges have disagreed in several prominent cases, granting local villagers’ Native Customary Rights (NCR) claims to land taken over by the government.

Secondly, the new media has exposed ‘get-rich-quick’ land schemes to the world – and crucially, to many Sarawakians previously force-fed a steady diet of propaganda by state-owned television RTM and local newspapers.

Thirdly, the ruling political class is now confronted with the prospect of losing the majority of the urban Chinese-dominated seats in Kuching, Sibu, Miri, Sarikei and Bintulu, and even a sizeable number of rural Dayak seats in the upcoming state election to the Pakatan Rakyat.

Political observers are predicting a BN loss of a dozen urban seats, and a similar number of suburban and rural seats. This would be the largest swing since the BN consolidated its power in the 1991 state election, after nearly being replaced by the now-defunct Parti Bansa Dayak Sarawak (PBDS) and Permas in the 1986 ‘Ming Court Affair’.

‘Parade of federal leaders’

Commentators have even speculated that Chief Minister Taib Mahmud may step down immediately before the state election, and allow his deputy Alfred Jabu to lead a caretaker government.

This is seen as a potential last-ditch attempt to defuse criticism of Taib’s financial and land deals, both within and outside the BN, a bold gambit that would remove Taib as the prime target for a Pakatan campaign.

However, other observers point out this ‘shock’ scenario would lead to vicious and potentially insoluble infighting within the state BN since Taib has traditionally imposed his control over the factions in his PBB by playing off political rivals in the party against one another.

azlanUntil now, BN leaders have forged a united front, backing Taib to lead them into the election, saying he is the ‘glue’ that keeps the BN together.

“There has been a groundswell in recent months in northern Sarawak: (Sarawak PKR chief) Baru Bian is expected to win in Ba’kelalan,” an influential Sarawak politician told Malaysiakini, “so there’s been a parade of federal BN leaders visiting Lawas and Limbang, including (information minister) Rais Yatim and (deputy premier) Muhyiddin Yassin this month, and (premier) Najib Razak next month.

“These visits have produced headlines like ‘Lawas may get a new airport’ or ‘Plans afoot for a new hospital’ or ‘Malaysia ready to build bridge at Pandaruan in Limbang’ – they must be terrified of Baru Bian winning,” he said.

NONEBaru Bian (right) is from the minority Lun Bawang ethnic group in a state made up entirely of ethnic minorities. He was raised in Ba’kelalan, a hilly, poor region upriver from Lawas.

Baru Bian, then an independent candidate, lost in Ba’kelalan to Nelson Balang Rining of the BN by 475 votes in the last state polls in 2006. He then mounted an unsuccessful election petition seeking to nullify the result; in his petition, he alleged Nelson Balang and his agents had resorted to vote-buying by giving cash to voters.

‘Game changing’ rulings

Baru Bian and a handful of other land rights lawyers have been responsible for a string of recent landmark rulings in NCR cases against the state government. The judgments have returned forests to native Iban, Malay and other landowners throughout Sarawak, following intrusion by logging or plantation business interests with powerful backers in the government.

NONE“These cases are changing the game,” says Muhin Urip, a native land rights advocate. “These rural people are showing real courage, standing up to the state government, and to the big bullies in the logging sector. They’ve shown no fear, even after they were harassed by gangsters, by police and by the authorities.”

The NCR judgments hinged on the native plaintiffs demonstrating that they had cleared or used land, for dwellings, fruit trees, burial sites or shrines, or usual rights of way to their farms or cemeteries, before the beginning of 1958.

The state government has insisted that the onus of proof lies squarely on the native communities themselves. Aerial photographs dating from colonial times have been invaluable in helping native villagers win their NCR lawsuits.

The Federal Court, the highest legal authority in Malaysia, has recognised that forests reserved for hunting and collecting produce, or ‘pulau’, and the territorial area in which the forest is located, or ‘pemakai menoa’, fall under the realm of NCR.

But the state government has not, to date, altered its land policies.

High-profile Penan lawsuits

Over the past decade, Baru Bian has taken on several high-profile Penan NCR battles, including a new Ba Jawi lawsuit announced last week.

azlanHowever, the Penan have yet to win a pivotal legal decision, similar to those obtained by the Malays and Ibans in Sarawak, and the Orang Asli in the peninsula.

This is because Penan NCR claims are complicated by the fact that most of the 12,000 to 15,000 Penan have only settled in the last few decades. The Penan were mainly nomadic, with precious few permanent crops or dwellings, before 1958.

But lawyers for the Penan argue their NCR claims are no different from other communities’, since the Penan also rely on the forests for their food and survival. They say the traditional Penan practice of ‘molong’, putting aside forest resources for shared use, is almost identical to the Iban custom of preserving ‘pulau’ for communal use.

“By and through their customary practice, mostly characterised as ‘molong’, tribal groups of the nomadic Penan lived in and within distinct territories. Traditional dwelling huts called ‘lamin toro‘ were left behind as distinct marks of earlier settlements,” the Ba Jawi plaintiffs said, in their statement of claim to the High Court.

“Ba Jawi Penans, like the 200-plus communities who have taken companies and the Sarawak government to court for NCR land rights, are being forced to seek the judgments for justice and for the people’s rights to be defended,” said See Chee How, a lawyer for the Ba Jawi villagers.

“Beyond the court case, the untold sufferings of the Ba Jawi people and others in similar cases mustn’t be hidden. Land to the native people isn’t just property, it’s a crucial aspect of the living history of the community, and very much the lifeline of the people.”

Will filthy rich Taib finally call it quits?

KUCHING: Speculation that Sarawak’s longest-serving Chief Minister Taib Mahmud might step down following his recent marriage to a young Arabic woman has resurfaced.

Currently, Taib and his young wife are away honeymooning in Paris. Word on the ground is that as soon as he returns to Sarawak this month, he will be tendering his resignation from his post which he has held for more than 30 years.

Taib’s deputy, Alfred Jabu Anank Numpang, is expected to take over as acting chief minister.
Jabu, the deputy president of Pesaka Bumiputers Bersatu (PBB), will also be assigned to lead the state Barisan Nasional (BN) into the next state election which must be called before July 2011.

The latest rumours have generated interest not only among the public, but also among Taib’s Cabinet ninisters. One has even asked his aides to find out more “details” of the rumours.
According to the political grapevine here, after the state elections Jabu will step aside and give way to someone that Taib can trust.

Currently two names are being tossed about as possible replacement for Taib.  One of them is Wahab Dollah, a Melanau and the MP for Igan.

He is tipped to contest in Taib’s current state seat of Balingian in the coming election. The other name mentioned is the former federal minister, Effendi Norwawi.

Adenan Satem, a one-time a leading contender to the post of chief minister may, however, be given another appointment.

Some say he may be appointed the next Sarawak governor. He is currently the special adviser to the chief minister, holding the rank of a minister.

KL fears Taib’s scandal

State Minister of Housing and Urban Development, Abang Johari Openg, who is also a deputy president of PBB, has been relegated to the bottom of the list.

Eventhough Kuala Lumpur wants Johari to take over as the next chief minister, Taib does not trust him.

In fact, the acrimony between Johari’s family and Taib go back to the construction of the Merdeka Hotel about 10 years ago. The hotel is owned by Johari’s family members.

Until today no government function is allowed to be held at the hotel according to a “directive” from Taib. Such is the extent of their enmity.

But for the sake of “Muslim unity” they appear to be in good terms. Taib’s uncharacteristic lack of resistence to Kuala Lumpur’s pressure for him to step down is rumoured to be linked to a forecast by his personal bomoh.
Rumour is that the bomoh has warned Taib to step down before the state election, otherwise something “bad” will happen to him.

Prime Minister Najib Tun Razak, meanwhile, does not want Taib to be the main campaign issue against the Barisan Nasional in the state election.

Primary cause

During the May 2010 Sibu by-election, Taib was said to have been the primary cause for the loss of Bandar Sibu, the BN’s stronghold to DAP.

In the coming election, Najib does not want allegations of abuse of power, corruption, nepotism and cronyism to be used against Taib and the BN.

Extensive reports of abuse and Taib’s colossal wealth in Sarawak and abroad have been widely circulated on the web.

Among the allegations exposed by online newsportal Sarawak Report are Taib’s billion dollars worth of foreign properties in Australia, Canada, the US and London, NCR lands being leased to his crony companies and members of his family and land grab issues.

Taib has not responded to any one of these allegations. Local reporters have been barred from asking Taib questions regarding these allegations.

The Malaysian Anti-Corruption Agency (MACC), too, has remained conspicuously silent although several reports have been lodged with the MACC against Taib.

MACC’s silence is irking opposition parties which are shoring up voter support in Sarawak by flagging Taib’s alleged pillage of Sarawak.

Harga petrol RON97 akan dinaikkan 10 sen lagi kepada RM2.40 seliter berkuatkuasa tengah malam ini, mengikut sumber.

Bagaimanapun harga petrol RON 95 kekal tidak berubah pada RM1.85 seliter.

Harga petrol RON 97 sejak tahun lalu, tidak ditetapkan kerajaan kerana ia diapung mengikut pasaran minyak dunia semasa.

Pada 1 Nov lalu, harga petrol RON97 dinaikkan 5 sen menjadi RM2.15 seliter dan akhir bulan yang sama ia dinaikkan lagi 15 sen lagi kepada RM2.30 seliter.

Harga minyak tanah juga naik 10 sen kepada RM2.50 seliter.

Syabas Kerajaan BN kerana sekali lagi menaikan harga minyak RON97.Pada 1 Disember 2010,harga RON97 dinaikkan 15 sen kepada RM2.30 seliter.Sekarang,naik lagi 10 sen ke RM2.40.Penstrukturan Semula Subsid (Kata Datuk Seri Idris Jala)
