SPRM : Saya Peminat Ringgit Malaysia, Saya Pun Rasuah Mah

Harapkan Pagar, Pagar pula makan padi beginilah keadaan di Malaysia kini. Jabatan- jabatan penguatkuasa undang-undang bukan sahaja semakin berani memukul arus perubahan kehendak rakyat malah mereka sanggup menggadaikan Intergriti Negara.

Kita harap polis jaga keamanan Negara , tapi mereka pukul suspek sampai mati. Kita harapan Jabatan Penjara pulihan penjenayah tapi mereka dilatih menjadi mahir. Kita harapankan Suruhan Jaya Pencegah Rasuah Malaysia (SPRM) , tapi mereka kejar kes kecil-kecilan.

Ratusan Billion ringgit tidak ada sebarang tindakan,sebaliknya hanya -hanya kes rasuah beberapa ringgit dibawa ke muka pengadilan. Mungkinkan sebabnya kerana yang patut mengawal Korupsi itu sendiri Korup.

Tapi tiba-tiba Ketua Pengarah Suruhanjaya Pencegahan Rasuah Malaysia mahu mengundur diri dengan melantik timbalannya sebagai penganti, kenapa? Mungkinkah dia sendiri menyalah gunakan kuasanya?

Saya difahamkan bahawa :

a. Kementerian kewangan tidak membenarkan pemberian Kontrak dengan secara Rundingan Terus atau Direct Negotiation. Kelonggaran hanya diberi dalam keadaan berikut :

i. Peralatan yang hendak dibeli hanya dibuat oleh syarikat/pengeluar/pembuatberkenaan dan tidak boleh diperolehi di pasaran terbuka “open market” atau “off shelf”

ii. Peralatan yang hendak dibeli dibuat oleh syarikat/pengeluar/pembuat kepada spesifikasi kerajaan yang khusus atau “specific requirement” mengikut keperluaan pengguna

iii. Keperluaan kerahsiaan peralatan tersebut seperti alat komunikasi pasukan elite yang menggunakan frekuensi khas agar tidak berlaku ‘tapping’ atau ‘jamming’

iv. Lain-lainkeadaan yang mengambil kira keperluan kerajaan.

b. Pakaian Seragam Angkatan Tentera Malaysia, Kastam DiRaja Malaysia, Immigresen , BOMBO, JPA, Maritim Malaysia, RELA dan lain-lain diperolehi secara Tender terbuka dan Sebutharga terbuka bagi setiap jenis peralatan yang melengkapkan pakaian seragam.

Tidak pernah sehingga kini kita ketahui Badan-Badan beruniform di Malaysia member Kontrak perolehan Keseluruhan peralatan Pakaian Seragam kepada SATU SYARIKAT SECARA ‘HEAD to TOE’. Ini adalah kerana tidak ada satu syarikat di Malaysia yang membuat atau mengeluarkan semua jenis peralatan seragam dan kebanyakan peralatan tersebut boleh diperolehi dari berbagai sumber dan ada yang ‘of the Shelf’

Ketua Pesuruhjaya Suruhanjaya Pencegah Rasuah Malaysia telah memberikan Kontrak yang dianggarkan bernilai RM 7.5 juta ringgit melalui rundingan terus serta meluluskan pembelian HEAD TO TOE kepada hanya satu syarikat iaitu Syarikat Mariwasa Kraftangan Sdn Bhd yang beroperasi di Kuala Kangsar, Perak. Mariwasa Kraftangan Sdn Bhd adalah pengeluar barangan logam seperti Pewter, Tembaga, Perak dan Emas dan adalah pembuat barangan seerti cenderahati , pingat-pingat dan keperluaan peralatan pakaian seragam yang hanya dibuat dari logam seperti pip, crown, star, collor dot dan lain-lain.

Mariwasa Kraftangan telah memperolehi kontrak pembekalan HEAD TO TOE walaupun mereka tidak mengeluarkan peralatan-peralatan seperti berikut :
a. Topi Peak Lelaki
b. Bawler Hat Wanita
c. Songkok
d. Baju/seluar Istiadat
e. Baju/seluar Mess Kit
f. Baju/Seluar Bush Jacket
g. Baju/Seluar Kerja
h. Tali pinggang Kulit
i. Stokin
j. Tudung
k. Pelbagai jenis kasut
l. Handbag Wanita
m. Tali leher
n. Aggauletter
o. Serta Lain-lain Jenis Pakaian.

Juga di fahamkan Mariwasa Kraftangan telah menggunakan beberapa syarikat lain bagi mendapatkan keperluan-keperluan ini di mana diantaranya adalah bukan pembuat/pengeluar tetapi adalah hanya orang tengah . Diantara syarikat-syarikat yang digunakan adalah seperti BENA YAKIN ENTERPRISE. Diantara barangan yang diperolehi dari syarikat ini adalah seperti:

b. Bawler Hat wanita
c. Songkok
d. Berbagai Jenis Kasut
e. Barangan Sulama
f. Aggaulette

Bena Yakin Enterprise adalah sebuah Perniagaan jenis Enterprise dengan hanya nilai modal RM2.00, tetapi memperolehi tempahan bernilai hampir Sejuta Ringgit. Yang lebih menghairankan ialah Mariwasa Kraftangan , pembuat barangan logam juga diberi kontrak JAHITAN PAKAIAN. Syarikat yang menjahit iaitu MAROZ TAILOR berpusat di Kuala Lumpur adalah bertaraf ‘High Class’.
Bagi Peralatan seperti Kasut dan tali Pinggang Kulit , Kementerian Kewangan “Treasury” menghendaki bekalan diperolehi dengan syarikat yang ada ‘Central Contract’ dan bukannya diberi kepada pembuat barangan logam yang kemudiannya perolehi daripada sebuah lagi Perniagaan Enterprise.

Kini, tiba masanya Perdana Menteri menjelaskan kepada Rakyat Malaysia kenapa Ketua Pesuruhjaya SPRM ingin berundur serta :

a) Apakah Dasar sebenar Kementerian Kewangan mengenai perolehan Rundingan terus

b) Mengapakah kesemua perolehan oleh SPRM atau BPR sebelum ini tidak dibuat secara tender atau Sebutharga?

c) Apakan hubugan Isitimewa Mariwasa Kraftangan dengan Ketua Pesuruhjaya MACC /BPR

d) Bagaimankan Kementerian boleh meluluskan perolehan Rundingan Terus terutamanya ‘Head to Toe’ kepada satu syarikat .

Saya juga meminta Perdana Menteri agar dekelasifikasikan Perjanjian atau Kontrak-kontrak pembelian segala peralatan melibatkan Ketua Pesuruhjaya SPRM tersebut semasa beliau berada di BPR/SPRM.

Pihak Kerajaan juga tidak seharusnya melindungi Kakitangan Kerajaan terutamanya mereka yang berpangkat Tinggi yang didapati mengugat Integriti Negara. Sudah tiba masa Suruhanjaya Pencegah Rasuah Malaysia diletakkan dibawah pengawasan Parlimen.

Saya juga akan mencadangkan bahawa suatu Jawatankuasa Khas Parlimen ditubuhkan untuk menyiasat tuduhan –tuduhan rasuah/pecah amanah yang melibatkan pegawai-pegawai tertinggi Kerajaan Malaysia.

GIATMARA bayar gula sekilo RM170!!!

The Treasury said in its explanation to the Auditor-General’s findings made public yesterday that the Giatmara centre had mistakenly paid RM170 per kg instead of RM1.70 per kg for sugar for a poverty eradication programme last year.
The reply, found in the 2010 audit report, said that “the mistake was not detected … resulting in overpayment of RM25,245.”

It added that after Giatmara sent written requests to JD Works Enterprise to reclaim the surplus payment, the supplier “agreed to return the difference by instalments.”

JD Works Enterprise paid RM1,000 a month from July to September 2011, leaving a balance of RM22,245.

Mara management then ordered Giatmara chairman Datuk Shahiruddin Ab Moin to investigate the matter on September 23, 2011. Read more here

Di Semenanjung BN hanya ada saki baki UMNO – Komponen lain akan hanyut

Di Semenanjung BN hanya ada saki baki UMNO – Komponen lain akan hanyut.

 
Kita sedikit sebanyak boleh membuat ‘prediction’ awal tentang apa yang akan berlaku di Semenanjung dalam pilihanraya nanti. Dalam pilihanraya yang lepas di Semenanjung BN telah memenangi hanya 80 kerusi termasuk kerusi yang di menangi oleh calun bebas yang menggunakan symbol PAS, iaitu Ibrahim Ali.

Dalam kumpulan 80 calon BN yang menang ini adalah 15 yang dimenangi oleh MCA, 1 oleh Gerakan dan 2 lagi oleh MIC. Lain-lain perkataan UMNO Semenanjung hanya memenangi 62 kerusi dan menjadi 70 kerusi jika di campurkan dengan kerusi-kerusi UMNO/BN yang dimenangi di Sabah.

Jika UMNO mampu mempertahankan semua kerusi yang dipertandingkan di Semenanjung ia bermakna UMNO hanya mempunyai 62 kerusi selain dari tambahan sebanyak 8 kerusi di Sabah (jika menang). Jika MCA tewas di 11 kerusi di Semenanjung seperti yang di telah di ramal oleh banyak pihak maka BN di Semenanjung hanya memenangi 67 kerusi kesemuanya. Justru BN terpaksa menjadikan Sabah dan Sarawak sebagai tumpuan untuk mencukupi kerusi bagi membentuk kerajaan dengan majoriti mudah 112 kerusi.

Jika di dasarkan kepada kemenangan BN sebanyak 67 kerusi di Semenanjung maka BN harus mencari 55 kemenangan kerusi di Sabah dan Sarawak untuk mendapatkan kemenangan mudah di Parlimen. Tetapi di Sabah dan Sarawak jumlah kesemua kerusi Parlimen ialah, 26 di Sarawak dan 25 di Sabah dan jumlah kesemuanya di kedua-dua negeri Malaysia Timor ini hanyalah 51 kerusi.

Jika BN memenangi kesemua kerusi di kedua buah negeri ini pun ianya tidak akan dapat mencapai matlamat untuk menubuhkan kerajaan mudah di Persekutuan. Persoalannya sekarang ialah mampukah BN memenangi kesemua 56 kerusi Parlimen di Sabah dan Sarawak sedangkan DAP sedang mengembangkan pengaruhnya di Sarawak terutamanya di Kawasan-kawasan Bumiputra Sarawak.

DAP mempunyai ‘advantage’ besar kerana parti itu adalah parti multi-racial yang boleh dianggotai oleh mana-mana suku kaum pun termasuk Iban, Dayak dan lain-lain. Dalam pilihanraya negeri Sarawak baru-baru ini kita telah melihat kemenangan DAP di 12 kerusi Dewan Undangan Negeri di kawasan-kawasan bandar di sana.

Banyak pihak berpendapat yang BN akan kehilangan 8 kerusi Parlimen di Sarawak dan 7 kerusi Parlimen da Sabah. Maka kedua-dua buah negeri ini BN hanya mampu memenangi 41 kerusi dari 56 kesemuanya.

Jika 67 kemenangan BN di Semenanjung (termasuk MCA) di campurkan dengan 41 kerusi di Sabah dan Sarawak, maka BN akan hanya memenangi 108 kerusi keseluruhannya dan kita tidak nampak bagaimana BN boleh diyakini akan mampu menubuhkan kerajaan walaupun dengan ‘simple majority’.

Di dalam perkiraan apa sekali pun kita mesti meletakan angka untuk kontijensi. 67 kerusi yang ditelah akan di menangi oleh BN itu harus mempunyai peratusan kontijensinya. Kita tidak tahu lagi apa yang berlaku kepada BN di dalam percaturan pemilihan calun Parlimen ini.

Dalam perkiraan tadi kita tidak masukan kemungkinan Pasir Mas yang akan kembali kepada PAS yang sekarang di sandang oleh Ibrahim Ali. Ibrahim Ali telah memenangi kerusi itu di atas symbol PAS kerana jika Ibrahim Ali bertanding di atas tiket bebas sejarah telah membuktikan yang Ibrahim telah hilang wang pertaruhannya dalam pilihan raya 2004 dahulu. Pasir Mas dikatakan akan jatuh semula ketangan PAS.

Ramai di dalam UMNO menyatakan yang Tengku Razaleigh akan tidak di turunkan oleh UMNO kali ini sebagai calon. Jika berita ini benar maka Gua Musang juga akan jatuh ketangan PAS. Jika Pasir Mas dan Gua Musang jatuh ketangan PAS maka Jeli juga akan jatuh justru BN tidak akan mendapat apa-apa kemenangan di Kelantan.

Jika ini berlaku maka angka 67 kemenangan BN di Semenanjung tadi akan jatuh kepada 64 sahaja. Saya berkesempatan untuk berbincang dengan pemimpin-pemimpin UMNO di Terengganu akhir-akhir ini. Saya di beritahu oleh mereka yang UMNO di negeri Terengganu tidak akan mampu memenangi di sekurang-kurangnya 3 kerusi Parlimennya kerana pergolakan besar di dalam UMNO di negeri itu Jika berita ini benar maka bilangan kerusi BN di Semenanjung akan turun lagi kepada 61 kerusi sahaja.

Angka kemenangan BN sebanyak 61 kerusi ini belum lagi mangambil kira kerusi-kerusi BN yang dijangka dengan jelas akan menghadapi kekalahan. Satu-satunya kerusi yang dimenangi MCA di Selangor iaitu Ampang yang sekarang di sandang oleh Ong Tee Kiat akan menjadi milik DAP atau mana-mana parti PR.

Di jangkakan kerusi BN Raub akan tumbang juga dengan berbagai-bagai isu peribadi Ng Yen Yen dan di Johor sahaja BN dikatakan akan kehilangan sebanyak 3 lagi kerusi Parlimen. Jika di tolak 5 lagi kerusi ini dari 61 untuk BN tadi maka BN di Semenanjung akan hanya memenangi 56 kerusi kesemuanya.

Jika 56 kerusi di Semenanjung ini di campurkan dengan 41 kerusi di Sabah dan Sarawak maka angka kemenangan BN keseluruhannya akan berlegar di angka 97 kerusi sahaja. Sejak beberapa bulan yang lepas ada pihak yang sentiasa memberitahu saya yang BN akan memenangi lebih sedikit dari 90 kerusi.

Semasa itu saya tidak dapat mempercayainya kerana tidak diberitahu angka itu secara saintifik. Tetapi apabila perkiraan ini dilakukan maka saya sudah nampak lojiknya bagaimana 97 kerusi itu hampir menjadi kenyataan. Yang penting yang mesti diketahui ramai ialah di Semenanjung BN itu hanyalah UMNO kerana parti-parti komponennya akan pupus dalam politik negara selepas pilihanraya yang akan datang.

Nazri Aziz telah menafikan yang beliau melamar DAP untuk bersama BN tetapi sebenarnya beliau benar-benar membuat tawaran tersebut. DAP telah menolak lamaran itu kerana tawaran itu hanyalah sebagai tindakan desperate satu parti yang telah lemas dengan kuasa serta telah hilang segala hidayahnya.

Oleh kerana itu jika kita dasarkan kepada hukum akal kita jelas BN akan tewas di dalam pilihanraya yang akan datang. Hanya perkiraan Tuhan sahaja yang akan mengubah apa yang telah di kira tadi. Perkiraan yang ditulis ini hanya perkiraan manusia yang serba serbi lemah ini dengan tambahan sedikit dengan ‘intuition’ yang ada pada diri saya. Masalahnya ‘intuition’ saya selama ini banyak juga yang menjadi kenyataan.

Kepada sesiapa dan pihak yang tidak suka kepada ‘intuition’ yang ada pada diri saya ini supaya berdoa agar kali ini apa yang saya rasakan itu adalah salah. Semua pihak hanya perlu berdoa sahaja sekarang ini agar yang maha menghakimi akan membuat penentuan. Setakat ini itu semua hanyalah perancangan manusia sahaja.

Hanya DIA sahaja akan menentukan segala-galanya.

Utusan’s Ridhuan Tee defends removal of crosses at Xmas party

 KUALA LUMPUR, Jan 2 — Utusan Malaysia columnist Dr Ridhuan Tee Abdullah defended today the action by aides of Datuk Seri Najib Razak who sought the removal of Christian symbols at a Christmas gathering a week ago.
 
The conservative Universiti Pertahanan Nasional Malaysia lecturer said the instruction did not violate freedom of religion, and urged the Christians to respect the prime minister’s Islamic faith.

“In my opinion if there is any truth in the report, the request of the prime minister’s office is tolerable. It has nothing to do with violation of religious freedom, except for those who seek political mileage,” said Tee in his weekly column published by Utusan Malaysia’s Sunday edition, Mingguan Malaysia.

Notes:He is staunch supporter of UMNO,so what do we expect?This is 1Malaysia as being championed by our Prime Minister Najib?Yes,talking about Respect.Is it a Mutual Respect or a One Sided Respect?

He said Christians have never been prevented from celebrating Christmas despite forming less than ten per cent of the population and indicated that the community should tone down its celebration to reflect its population size.

“Christmas celebration sometimes looks as if they form more than 50 per cent of the population. Out of respect for religious freedom, no restriction has been imposed, although it should be celebrated moderately as they are less than ten per cent of the population,” he added.

Notes:This is what happen when someone or somebody starts to talk about Majority Vs Minority.Why do you have to talk about majority and minority?By being a majority,you have more authority to imposed restrictions and tolerance to the minority?Why do we have to moderate ourself in our Religion and Belief?Isnt it something that we called Injustice as far as the Article 11 of the Federal Constitution is concerned!!

Last week, The Malaysian Insider reported that Najib’s aides had instructed church officials to remove crucifixes and other overt Christian symbols from being displayed at the party grounds in Bukit Nanas before the PM’s visit, in their zeal to protect his Islamic credentials.

Hymns and prayers were also barred.

Sources disclosed that the orders were issued without the PM’s knowledge. He is now away on holidays in Dubai and is due to return this week.

Notes:With or without PM knowledge is not the issue.The issue is such order shouldnt arise at all!! We have former aide to the Prime Minister who made a Racist remarks and here goes another one,a Religious Bigots!! Again.1Malaysia Slogan is questionable!

It was Najib’s first time attending a Christian function in his official role since taking over power in April 2009.

Tee, however, said Najib’s presence at the Christmas celebration was a major compromise made as a Muslim.

“True, Christians have every right to mark the celebration. But shouldn’t they show some respect to the prime minister as the No 1 leader who is a Muslim?” asked Tee.

Notes:Like i said,Respect and Tolerance should be in MUTUAL.Compromise?Yes.dont talk about Compromise when you only compromise in 1 thing but say NO to the other 10!!Shouldnt the Prime Minister or BN Government compromised too with the Christians regarding the usage of the words “ALLAH” with the Christians?Why do you need to imposed restrictions to others in the name of  “Compromise”?

“According to the Islamic laws, Muslims are not supposed to attend many of the non-Islamic celebrations, but for the sake of promoting tolerance and harmony, our leaders decided to close one eye.

Notes:If that is the case,if it is probihited according to Islamic Laws,why dont he just choose not to attend it?This issue would never arise at all.Isnt it something that we called Hypocracy?Or his attendance to the gathering is just a Political Gimmick to win over the hearts of the Christians?

“In my opinion, even without the instruction, the church should have understood Muslim sensitivities in the country after 53 years of independence. However, if it is no longer an issue, I suggest for the Selangor or Kelantan mentri besar to one day officiate the opening of a temple or a church. I am confident non-Muslims too would not be comfortable if we have them attend Islamic celebrations in mosques,” he added.

Both states mentioned are run by Pakatan Rakyat (PR) governments and have been subject to criticisms by Tee, who has never hidden his admiration for Umno and its policies.

Notes:Now,that is a Political question!! If one claimed that someonelse purposely raise up this issue for Political Mileage,so how does he justify this type of question? Apolitical?

Tee also said that Najib would suffer political setback if his aides had not taken the precautions.

“Imagine if the prime minister was not cautious when entering the ‘house of worship’, pictures of the prime minister with a crucifix over his head would surface. It will be politicised by the opposition,” said Tee.

“I still remember how a crucifix was used to undermine a Muslim leader not too long ago. It does not matter who did it, but the incident should be a lesson,” he added.

He was referring to the campaign in Election 1990 when photographs of then Semangat 46 leader Tengku Razaleigh Hamzah wearing a Kadazan headgear with a crucifix symbol was distributed. The photograph was printed by Umno-controlled newspapers on the eve of the election and was said to have helped secure victory by Barisan Nasional (BN) under then prime minister Tun Dr Mahathir Mohamad.

Notes:Million Dollar question is,who has Politicised it before?Wasnt it UMNO?Now,please put your brain in your head.The same issue that you raised up is only pointing 10 other issues to yourself or UMNO or perhaps,your own Party

Tee said to avoid similar controversy in the future, Christmas celebrations should be held in public places and not in church grounds.

“We hardly see hari raya open house celebrations being held in mosques out of respect to non-Muslim’s sensitivity. Celebrations are usually held in public places to avoid controversy. The main objective is unity,” he said.

Notes:Again,it shows that you are suggesting and imposed restrictions to others!! It is our Religion and Belief,it is not you or anyonelse to imposed restrictions or guidelines to us the Christians!! Unity yes,but what kind of Unity?Ask yourself!!

The Christmas party last week was hosted by Catholic Archbishop Tan Sri Murphy Pakiam and held at the car park of his official residence in Cardijn House in Jalan Bukit Nanas.

Ps:I have no problems with the Muslims or Islam,in fact some of my own relatives were married to Muslims,there would be a True Unity in every sense of words if we kick this Racial and Religious Bigots out in the next General Election.Without UMNO,Malaysia would be a better place for all Malaysians irrespective of Race and Religions.

As far as UMNO is concerned,there is no such thing as RESPECT,TOLERANCE and COMPROMISE!!

KUALA LUMPUR, July 31 — Malaysian Anti-Corruption Commission (MACC) chief commissioner Datuk Seri Abu Kassim Mohamed today intends to push the Najib administration members to declare their assets publicly.The Cabinet members now declare their assets to Prime Minister Datuk Seri Najib Razak annually but it is not made public.

“Declaration of assets is very, very important,” Abu Kassim said at the 15th Malaysian Law Conference at the KL Convention Centre here.

The nation’s top graft fighter was responding to a suggestion from former Bar Council president Datuk Ambiga Sreenevasan that the assets of politicians — particularly those in the Cabinet — and the judiciary be made publicly available for the sake of transparency.

“I agree with you… Everybody — for example, the minister or the judiciary — has to declare,” he told Ambiga.

Following the thumping Barisan Nasional (BN) took in the March 2008 general election, then-Prime Minister Tun Abdullah Ahmad Badawi had directed Cabinet members to declare their assets in a bid to appease a public that was increasingly sceptical of BN’s capacity for reform.

Ministers, as well as deputy ministers, were required to fill in asset declaration forms with the MACC’s predecessor, the Anti-Corruption Agency (ACA), with the intention of making the information available online for public scrutiny.

However, Abdullah backed down from this plan after facing stiff opposition from ministers, who felt that it would be an invasion of privacy for the public to know their financial worth.

Abu Kassim earlier assured Ambiga that he was willing to investigate cases involving Cabinet members impartially without any regard to their political affiliation.

“I can assure you, if there is a case… against any Cabinet member and we didn’t investigate, I’m willing to go down,” he declared, by way of assurance.

He added that he was, in fact, already investigating Cabinet members for alleged corrupt practices but stopped short of elaborating.

MACC has come under sustained fire after its January 2008 start for what detractors claim is a poor record of prosecution and ineffective fight against corruption.Read more here

PKFZ: Ling hadapi tuduhan tipu kerajaan M’sia

Bekas menteri pengangkutan, Tun Dr Ling Liong Sik hari ini didakwa di Mahkamah Sesyen Putrajaya atas tuduhan menipu kerajaan Malaysia dengan memperdaya Jemaah Menteri berhubung pembelian tanah untuk projek ”Mega Distribution Hub” di Pelabuhan Klang.

 

 

 

Ling, 67, juga adalah bekas presiden MCA.

Beliau tiba di mahkamah pada jam 4.45 petang dengan ditemani isterinya, Toh Puan Ena Ling serta dua anak lelakinya.Ling kemudian mengambil tempatnya di kandang tertuduh.Beliau adalah presiden MCA yang kedua dihadapkan ke mahkamah selepas Tan Koon Swan.

Ling didakwa menipu kerajaan sekitar 25 September 2002 dan 6 November 2002 dengan memperdayakan jemaah menteri untuk memberikan persetujuan pembelian tanah di Pulau Indah untuk projek Mega Distribution Hub di Pelabuhan Kelang.

Dia juga didakwa dengan curang menyembunyikan fakta berhubung penilaian Jabatan Penilaian dan Perkhidmatan Harta, Kementerian Kewangan ke atas tanah seluas 43,538,200 kaki persegi yang dicadangkannya. 

 

 

Ling yang memegang jawatan Menteri Pengangkutan selama 14 tahun dari Januari 1986 hingga Mei 2000, didakwa atas satu pertuduhan utama mengikut Seksyen 418 Kanun Keseksaan dan satu pertuduhan pilihan mengikut Seksyen 417 kanun yang sama.

 Seksyen 418 Kanun Keseksaan yang membawa hukuman penjara sehingga tujuh tahun atau denda atau kedua-duanya sekali jika sabit kesalahan.

 Manakala pertuduhan alternatif mengikut Seksyen 417, Kanun Keseksaan, yang membawa hukuman lebih ringan iaitu penjara sehingga lima tahun atau denda atau kedua-duanya sekali.

 Beliau bagaimanapun mengaku tidak bersalah dan membayar ikat jamin RM1 juta dengan seorang penjamin.Read more here

Asri urges review of Islamic laws on banned words

KUALA LUMPUR, Feb 15 — Influential cleric Dr Mohd Asri Zainul Abidin (picture) has come out to ask all states to review their Islamic enactments that bar non-Muslims from using terms and words such as ‘Allah’, saying laws should be updated from time to time.

The former Perlis mufti defended Shah Alam MP Khalid Samad’s proposal for Selangor to review laws such as its Non-Islamic Religion Enactment 1988 (Control of Propagations Among Muslims) that has raised the ire of some Muslims.

“Yes, I feel the proposal should be considered as part of contemporary development. The requirements from the past and present are not the same at all,” Asri told The Malaysian Insider in an exclusive interview yesterday.

Khalid’s proposal came in the wake of the controversial High Court ruling last Dec 31 when the Catholic weekly Herald was given the constitutional right to use the word ‘Allah’ to describe the Christian God among the Catholic congregation to the consternation of Muslims who say its exclusive to them.

“If the Internal Security Act (ISA) can be reviewed, don’t tell me these others laws cannot be reviewed,” he said, pointing out there are many words and phrases that have been barred from usage by non-Muslims.

Ten of Malaysia’s 13 states have banned non-Muslims from using up to 35 Arabic terms including the word ‘Allah’, ‘solat’ or prayers and even ‘masjid’ or mosque.

“How can we propagate our religion to others if we stop them (non-Muslims) from using certain words,” he asked.

Asri said the government should issue clear guidelines on such usage rather than rely on enactments.

Kepala babi dilontar dalam perkarangan dua masjid

Kepala babi ditemui dilontarkan ke dalam perkarangan dua buah masjid sekitar Jalan Klang Lama hari ini.

Kepala babi berkenaan dijumpai di perkarangan Masjid Jumhuriyah, Taman Datuk Harun di Petaling Jaya dan Masjid Al-Imam Al-Tirmizi, Taman Seri Sentosa, Jalan Klang Lama.

Insiden itu merupakan yang terbaru perbuatan merosak dan mencemarkan rumah-rumat ibadat sepanjang tiga minggu lalu, yang membabitkan 11 gereja, sebuah kuil Sikh, sebuah masjid dan dua surau.

Serangan ini dipercayai ada kaitan dengan keputusan Mahkamah Tinggi pada 31 Disember lalu yang membenarkan bukan Islam menggunakan kalimah Allah sebagai terjemahaan untuk ‘God’.

Menurut saksi, dua kepala babi dijumpai oleh jemaah di perkarangan masjid ketika datang hendak menunaikan solat Subuh pada jam 5.30 pagi.

Selain kepala babi, kepingan wang kertas juga ditemui ditaburkan di di situ.

Ketua Polis Negara, Tan Sri Musa Hassan dan pegawainya datang untuk menyiasat kawasan kejadian.

Four reasons for controversial ‘Allah’ ruling

KUALA LUMPUR, Jan 17 —  High Court judge Datuk Lau Bee Lan’s controversial ‘Allah’ ruling that rocked the nation over who had rights to the term cited that the Home Minister and government’s actions had been illegal, unconstitutional, irrational and had failed to satisfy that it was a threat to national security.

She also wrote about the apparent conflict in the matter between the Federal Constitution and the various state enactments apart from claims by Muslim groups that the matter cannot be taken to a civil court.

The judge released the written grounds of her Dec 31 judgment late on Friday while the increasingly acrimonious public debate over who has the right to use the word “Allah” continues to rage on.

The Malaysian Insider obtained a copy of her 57-page judgment where the judge lays out the reasons and the laws behind her oral pronouncement.

In laying out her judgment, Justice Lau ruled that the Home Minister and the Government of Malaysia, who were named as 1st and 2nd Respondents respectively, has the discretion under Section 12 of the Printing Presses and Publications Act to issue or revoke a permit to the Archbishop of Kuala Lumpur Reverend Tan Sri Murphy Pakiam (the Applicant) to publish the Church’s newspaper, Herald — The Catholic Weekly.

But, she stressed, the respondents had made decisions that were illegal, unconstitutional and irrational when they barred the Catholic newspaper from publishing the word “Allah” in its Bahasa Malaysia section.

Below are excerpts highlighting the main disputes.

* On why the Home Minister’s ban is illegal

“The Applicant submits the 1st Respondent has failed to take into account one or more of the relevant considerations…

1. The word “Allah” is the correct Bahasa Malaysia word for “God” and in the Bahasa Malaysia translation of the Bible, “God” is translated as “Allah” and “Lord” is translated as “Tuhan”;

2. For 15 centuries, Christians and Muslims in Arabic-speaking countries have been using the word “Allah” in reference to the One God. The Catholic Church in Malaysia and Indonesia and the greater majority of other Christian denominations hold that “Allah” is the legitimate word for “God” in Bahasa Malaysia;

3. The Malay language has been the lingua franca of many Catholic believers for several centuries especially those living in Melaka and Penang and their descendants in Peninsular Malaysia have practised a culture of speaking and praying in the Malay language;

4. The word “God” has been translated as “Allah” in the “Istilah Agama Kristian Bahasa Inggeris ke Bahasa Malaysia” first published by the Catholic Bishops Conference of Malaysia in 1989;

5. The Malay-Latin dictionary published in 1631 had translated “Deus” (the Latin word for God) as “Alla” as the Malay translation;

Speak up on ‘Allah’, Kit Siang urges Borneo ministers

IPOH, Jan 16 — DAP strongman Lim Kit Siang has asked all Cabinet ministers from East Malaysia to declare if they agreed with Minister in the Prime Minister’s Department, Datuk Seri Nazri Aziz’s bid to strike a compromise by allowing only Christians in Sabah and Sarawak to use “Allah”.

The Ipoh Timur MP today slammed Nazri for his statement, which was front-paged in Kuching daily The Borneo Post yesterday, saying that his words made a total mockery of Prime Minister Datuk Seri Najib Razak’s 1 Malaysia concept.

“It seems now we are having more and more segmentation and departmentalisation rather than 1 Malaysia,” Lim noted.

“I was struck by Nazri’s announcement because just a day earlier, our deputy prime minister (Tan Sri Muhyiddin Yassin) said, in his talk at the Oxford Islamic Centre, that there would be no more Allah contention in the future.

“I wonder what he meant by that?” he added.

He questioned if, by making such a statement, Muhyiddin had meant that there would no longer be any “insensitive statements” made by both the home minister and the prime minister — such as those stating they would not object to any demonstrations over the “Allah” issue — which he said had caused the series of attacks on churches nationwide.

“Or did he mean that in the future, the home minister would never impose a ban on the use of the word ‘Allah’ like what happened in 2007?

Jakim says ‘Allah’ ban must include Sabah and Sarawak

KUALA LUMPUR, Jan 16 — The Islamic Development Department (Jakim) maintains that Christians should not be allowed to use the word “Allah” and rejects the suggestion that the word could be used in East Malaysia while remaining banned on the peninsula.

Jakim director-general Datuk Wan Mohamad Sheikh Abdul Aziz said there should not be two sets of laws and rules to deal with the “Allah” issue.

The federal government’s highest Islamic body joins Christian leaders who also rejected today the suggestion made by Minister in the Prime Minister’s Department Datuk Seri Nazri Aziz who claimed in an interview with East Malaysian newspapers yesterday that the federal government had agreed for the word to be used in Sabah and Sarawak.

Wan Mohamad from Jakim said that since there were already rules on the matter, the word “Allah” should not be used by churches anymore. “We must respect the decision of the Cabinet.

“If we follow the spirit of respecting laws there has already been a decision at national level so they should not use the word,” he said.

He said that if the word “Allah” was allowed for Christians in Sabah and Sarawak it would not solve any problems because of the migration and mobilisation of people from the two East Malaysian states to the peninsula.

“That does not solve matters…we are in a small country and we need standard laws and rules.
