X-Fail: Persoalan yang belum terjawab

Rakyat Malaysia menunggu ketibaan 2010 mengharapkan jawapan kepada isu-isu yang belum selesai tahun ini. Berikut adalah 10 kes sepanjang 2009 yang belum selesai. Namun mungkin masih ada lagi yang tidak tersenarai di sini.

 

 

 

 Nasib Anwar bergantung pada bicara liwat 11

Awal bulan ini, parti komponen Pakatan Rakyat memperkukuhkan lagi kerjasama antara mereka dengan mempersetujui satu rangka dasar bersama.

Dengan mengetepikan ideologi politik, pakatan PKR-DAP-PAS telah berjaya duduk semeja untuk mengenal pasti bidang-bidang kerjasama dalam usaha untuk menawan Putrajaya dengan teraju Datuk Seri Anwar Ibrahim.

Bagaimanapun, masa depan Pakatan masih dilindungi awan gelap kerana Anwar sendiri berdepan dengan perbicaraan kes liwat – bagi kedua kalinya.

Ia sepatutnya perbicaraan terbesar 2009, tetapi ia tidak berlaku selepas ketua pembangkang itu memfailkan cabaran demi cabaran di mahkamah terhadap tuduhan tersebut.

Ketua umum PKR itu memfailkan banyak permohonan – daripada memohon mendapatkan tambahan maklumat, kepada permohonan untuk membatalkan tuduhan tersebut. Namun, penghakimannya tidak memihak kepada beliau.

Perbicaraan liwat tersebut dijadual bermula pada 25 Januari ini dan ditetapkan berjalan selama sebulan. Apakah Anwar akan merengkok di penjara untuk kedua kalinya? Dan apakah yang akan terjadi kepada Pakatan jika itu menjadi kenyataan?

 

 

 

 GST dan sumber minyak yang semakin kehabisan

Kerajaan dalam keadaan terdesak untuk memperolehi sumber kewangan tambahan selain daripada hasil sumber minyak dan cukai pendapatan. Petronas menyumbangkan 40 peratus daripda bajet negara sejak sekian lamanya tetapi keadaan ini mungkin terjejas kerana negara semakin kehabisan sumber itu diterokai.

Daripada 12 juta rakyat yang berkerja, hanya 1.8 peratus – atau 15 peratus sahaja – yang membayar cukai pendapatan. Yang lainnya berpendapatan rendah dan tidak perlu membayar cukai. Ekoran keputusan kerajaan mengurangkan cukai korporat daripada 40 peratus pada 1988 kepada 28 peratus sekarang, maka pengenaan cukai baru teramat diperlukan.

Maka munculkan cukai barangan dan perkidmatan (GST), yang dikatakan pada kadar 4 peratus dan bakal menghasilkan pendapatan tambahan RM1 bilion kepada kerajaan. Tapi kerajaan memerlukan tambahan kewangan lebih daripada RM1 bilion untuk menampung kekurangan kutipan cukai, maka GST dijangka meningkatkan pada masa akan datang.

Penentang GST berhujah bahawa ia menguntungkan golongan kaya kerana ia akan memindahkan beban membayar cukai kepada rakyat
biasa. Daripada memperkenalkan cukai baru itu, mereka menyarankan supaya kerajaan menangani pembaziaran dengan mempertingkatkan usaha membanteras rasuah dan memperkenalkan tender terbuka untuk projek kerajaan.

Sabah’s Untold History

Many Malaysians may not know this but the Perak Fiasco this year is not the second constitutional crisis that has rocked Malaysia (after the UMNO crisis). In fact, UMNO’s deregistration as an association by the Registrar of Societies in 1987 was also not Malaysia’s first constitutional crisis but the second.

The dubious award of Malaysia’s first ever constitutional crisis was bestowed on the Sabahan State Government in 1985 when the Berjaya-appointee Sabahan Governor, Tun Haji Mohd Adnan Robert, despite stern objections from his advisors including the Sabah State Attorney Datuk Nicholas Fung and Sabah High Court judge, Justice Datuk Charles Ho, had decided to swear-in a minority coalition party leader as the Chief Minister of Sabah, a coalition that had won less state seats (22 seats combined) in the just completed State Elections than the victor (26 seats), an action that contravened the State Constitution and the Federal Constitution of Malaysia.

So, what happened during the early dawn hours of 22 April 1985 that eventually propelled the State of Sabah into total chaos? An action by one single man in his capacity as the Governor? Or was he somehow “persuaded” (against all logical reasons) by Datuk Haji Yahya Lampong and the inaction of others present (except for Nicholas Fung and Charles Ho) to continue with the swearing-in ceremony? Before you continue reading, always keep this in mind. A Sultan or a State Governor can appoint a Menteri Besar or a Chief Minister but he cannot dismiss him after swearing him in. The appointed MB or CM can only be dismissed in the State Legislature by a vote of no-confidence, if he is convicted of a crime or if he dies in office.

Once again, let us start from the beginning.

Sabah held its state elections on 21 April 1985, a wide open contest between three political parties, namely Berjaya (BN component party and incumbent state government) led by CM Datuk Harris Mohd Salleh, USNO (previous BN component party and state government) led by Tun Datu Haji Mustapha Datu Harun, and the recently formed, months-old, Parti Bersatu Sabah (PBS), led by Datuk Joseph Pairin Kitingan (former Berjaya Vice President).

By 11pm on Election Day, it was evident that Berjaya had lost the Sabah state elections. CM Harris had in fact lost his seat in his Tenom constituency. The only Berjaya candidates that survived the backlash were the Speaker of the State Assembly, Tan Sri Haji Sunoh Marso, two deputy ministers, Haji Malek Chua and Hiew Ming Kong, plus three others.

Celebrations were however held at the USNO camp. At almost 1am on 22 April 1985, when USNO and PBS had jointly won 25 seats (simple majority), USNO’s director of elections, Haji Karim Ghani called Pairin’s residence to implement the secret plan between USNO and PBS to form a coalition state government, a plan hatched between Pairin and Mustapha to unseat Berjaya prior to the elections. The telephone call was answered by Pairin’s PBS legal advisor, Datuk Herman Luping, who told Haji Karim that “he will get back to him after speaking to Pairin”, a call that was never returned as PBS continued to win one constituency after another. Treachery? Well, nobody said that politics was clean. The initial pact was made at a time when neither USNO nor PBS thought that their respective party could win the Sabahan elections alone.

It was not until later when the return call never came that Mustapha realized that Pairin had double-crossed him. Moral of the story so far – never trust your political opponents.

It was also then that the State Attorney General Datuk Haji Yusuf Rashid, mentioned to Datuk Haji Yahya Lampong that USNO’s 16 seats plus Berjaya’s 6 seats (a total of 22 seats) were sufficient to form the State Government, provided that the Governor grant the 6 nominated seats to them. (The Sabah Governor has the privilege to do so as the Sabahan Legislature consists of 48 contested seats and 6 nominated seats.)

A call (at 2am) was hastily made to the USNO camp for a meeting between the two leaders. At 2.30am, Karim called Datuk Haji Majid Khan (Berjaya’s elections director) to confirm the meeting at Tun Mustapha’s residence. Majid and Abdul Malek Chua arrived about 15 minutes later and were taken to meet Mustapha. In the meeting, Mustapha was skeptical about this “plan of action” that could unseat PBS but a subsequent telephone call from the Istana “inviting Tun Mustapha to take the oath of Sabah CM” banished all doubts from the USNO President’s mind.

Why did the Governor do it knowing very well that PBS had won 26 seats to Berjaya’s 6 seats and USNO’s 16 seats? Events soon unfolded that Harris had called the Governor after receiving the call from USNO at 2am, informing him that Berjaya has formed a coalition with USNO and that their combined total of 22 seats plus the 6 nominated seats (by the Governor) constitutes a simple majority win in the 54-seat Sabah Assembly. It was then that instructions were given to Adnan’s ADC, Haji Mandalam Marziman, to prepare for the swearing-in ceremony in the wee hours of the night (or is it day?). It was also then that Madalam received a call from the PBS legal advisor, Datuk Herman Luping, as to whom he would need to contact to organize the formal swearing-in ceremony for Pairin as the CM of Sabah.

Suruhanjaya Di Raja Menyiasat RM100 Bilion Dan Kehilangan Enjin Pesawat

Gesaan untuk menubuhkan Suruhanjaya Di Raja bagi menyiasat kebenaran dakwaan Barry Wain; penulis buku Malaysian Maverick, bahawa Perdana Menteri Malaysia yang ke empat telah melesapkan sejumlah RM 100 billion khazanah negara dan juga isu yang memalukan apabila enjin pesawat milik tentera udara didapati hilang tidak sewajarnya dipandang remeh.

Kedua-dua isu tersebut ternyata berkepentingan umum dan rakyat berhak untuk mengetahui kedudukan sebenar dan memperolehi penjelasan yang munasabah. Malahan kesudian mantan perdana menteri untuk disiasat oleh Suruhanjaya Di Raja perlu disambut pentadbiran sekarang. RM 100 billion bukanlah sedikit jumlahnya.

Sungguh pun sudah ada beberapa tindakan susulan, misalnya penyiasatan terhadap kehilangan enjin pesawat itu, rakyat sebenarnya meragui kredibilti serta kebebasan mereka yang mengendalikannya. Kita jemu apabila meletusnya isu besar, yang dipersalahkan ialah penjawat awam, sedangkan jerung besar dibiarkan terlepas. Ini bukanlah kali pertama, lihat sahaja tindakan susulan terhadap Laporan Audit Negara. Kerugian berbillion ringgit, namun kambing hitam jua menjadi mangsa.

Oleh itu saya memandang serius sebarang usaha untuk mengalih perhatian rakyat dari isu sebenar. Tidak semena-mena “whistle blower” pula yang menjadi sasaran. Sekonyong konyong sahabat saya Lim Guan Eng disiasat di bawah Akta Hasutan. Ini bukanlah kali pertama Guan Eng berhadapan dengan rencana sebegini. Sebelumnya kerana bermaksud melindungi maruah seorang anak gadis Melayu, beliau terpaksa merengkok dalam penjara.

Turut dukacita apabila gagal dalam rayuannya di Mahkamah Rayuan pada bulan Disember tahun lalu ,Dr Munawar Ahmad Anees hari ini sekali lagi gagal dalam usaha membersihkan namanya dengan memohon agar dipadamkan sebahagian daripada penghakiman Mahkamah Persekutuan berhubung fitnah liwat yang membabitkan beliau. Beliau mencabar keputusan Mahkamah Sesyen yang telah menjatuhkan hukuman penjara enam bulan terhadapnya pada tahun 1998 kerana beliau telah dipaksa supaya membuat pengakuan dalam kes tersebut.

Sepatutnya institusi keselamatan dan keadilan menumpukan usaha untuk membanteras jenayah demi menjamin keamanan rakyat keseluruhannya. Tidakkah kematian dan kehilangan anak anak kecil kita mengetuk keinsafan pimpinan tertinggi pihak polis terhadap kelalaian mereka. Sedarlah rakyat bukan musuh anda! Rakyat sebenarnya sudah mual dengan kebobrokan yang berlaku. Mereka tidak mahu institusi yang sepatutnya melindungi kepentingan mereka bersekongkol dengan pimpinan umno-bn menutupi pekung busuk.

Walaupun Suruhanjaya Di Raja ditubuhkan untuk menyiasat kedua2 SKANDAL ini sekali pun tidak akan membawa kesan yang SIGNIFIKAN kerana kuasa pendakwaan masih berada di KUASA Peguam Negara.Sekira nya beliau memutuskan untuk tidak melakukan Pendakwaan,tidak membawa apa2 makna sekalipun.

Walaupun wujud nya bukti2 KUKUH untuk menyokong pensabitan tersebut.Suruhanjaya Di Raja yang menyiasat KESAHIHAN Video Linggam adalah salah satu BUKTI yang kukuh untuk MENGESAHKAN bahawa bidang KUASA Peguam Negara adalah tersangat lah luas dan BESAR.

Suruhanjaya Di Raja itu di antara lain nya telah menyarankan kepada Pejabat Peguam Negara agar Penyiasatan dan di susuli pula dengan Pendakwaan di jalankan kerana terdapat bukti2 kukuh yang mengesahkan KESAHIHAN Video tersebut dan PENGELIBATAN Linggam dan beberapa ahli2 Politik  termasuk Tun Mahathir dan Datuk Seri Tengku Adnan Mansur.

Tetapi apa yang berlaku adalah,Peguam Negara enggan membuka kertas siasatan walaupun atas cadangan dan di syorkan oleh Suruhanjaya Di Raja tersebut.Bukan kah ini salah satu bentuk PEMBODOHAN lunas Undang-Undang?Bukan kah ini salah satu bentuk penghinaan terhadap Ahli2 Panel di dalam Suruhanjaya Di Raja itu yang mana telah di lantik untuk mengesahkan KESAHIHAN Video Klip tersebut?Bukan kah ini salah satu penghinaan dari segi KEBIJAKSANAAN Ahli2 Panel itu?

Di dalam konteks ini,apakah tujuan dan relevan nya Suruhanjaya Di Raja itu di tubuhkan jikalau hanya sekadar untuk mainan SANDIWARA Politik untuk MELINDUNGI Si Perasuah Besar Negara?Walau apapun,kita seharusnya berbangga sejajar dengan Slogan MALAYSIA BOLEH!!!!!

Watchdog Backs Probe On Dr M, Pak Lah

The call for a royal commission to investigate claims that two former prime ministers had squandered hundreds of billions of ringgit during their tenure has received the backing of an anti-corruption watchdog.

Both Dr Mahathir Mohamad and his successor, Abdullah Ahmad Badawi, should be subjected to the investigations to restore credibility to the government, said Gerak chairperson Mohd Nazree Mohd Yunus.

“If these claims are not investigated, Gerak is concerned that the incidence of irregularities and corruption will be common practice in the future among national leaders, said Nazree in a statement issued today.

While integrity in the management of the country’s resources was crucial to the stability of the economy, the trust that foreign investors have towards the economy would also erode if political figures were allowed to get away with corruption and mismanagement, he added.

“If national resources such as petroleum and other natural resources are not managed with integrity, it is likely that our deteriorating economy will take a turn for the worst as a result of mega-scale corruption.”

Nazree’s statement come on the heels of a call by opposition stalwart Lim Kit Siang for a royal commission of inquiry to be set up to look into allegations that Mahathir had squandered RM100 billion during his 22 years as premier through grandiose projects and corruption.

The allegations were contained in a book penned by former Asian Wall Street Journal managing editor Barry Wain entitled ‘Malaysian Maverick: Mahathir Mohamad in Turbulent Times’.

Mahathir: Bring it on

In a posting in his Chedet blog, Mahathir said he welcomed Lim’s suggestion for the government to set up a royal commission to probe him.

At the same time, he said he “reserved the right” to sue Wain, Lim and Malaysiakini for defamation.

Mahathir added that the scope of the royal commission should be widened to look into the tenure of his successor-turned-nemesis Abdullah.

Such a probe should include how RM270 billion of Petronas’ money paid to the government during Abdullah’s five-year term was spent and how much money was lost due to the cancellation of the crooked bridge to Singapore, said Mahathir.

While acknowledging that the government did lose money over projects embarked on during his tenure, Mahathir however denied that the losses amounted to even RM10 billion, let alone RM100 billion.

“If we had lost RM100 billion, the government would be in deep trouble. But although we did have poor growth during certain years, the government never failed to meet all financial commitments including the servicing of loans. In fact, we had enough money to prepay loans.

The Home Ministry stated last week that it was in the process of determining whether Wain’s ‘Malaysian Maverick’ would affect peace and stability in the country.

The ministry has 60 days to make a decision as to whether the book could be sold in Malaysia.

Suruhanjaya Di Raja is some sort of  Budak Suruhan to UMNO led Barisan Kurang Rasional.It doesnt matter what is their FINDINGS in the INQUEST,it still the BIG OLD SHARK and all his friends going to be escaped from Justice and Law.

They seems to be INVISIBLE and LAW PROOF in any of their WRONG DOINGS.That has been the case for all this while.When it comes to Pakatan Rakyat members,the Police will do an INVESTIGATIONS in the speed of LIGHT regardless what is the issue.But for this PIRATES and ROBBERS who has ROB our country wealth for an ages?

I do remember what Datuk Nazri Aziz(De Facto Law Minister) said about the Linggam Video.”It is MORALLY GUILTY but not by LAW”…It seems like they were having a good MANNERS or MORAL when comes to CORRUPTION,at least in their WORDS but IRONICALLY they are not in their ACTIONS..What a JOKE!!!!

Enter Ultraman Mahathir

AT AN age when most senior citizens are slowing down, Dr Mahathir Mohamad often leaves much younger politicians gasping for breath in trying to catch up with his racy and, sometimes, controversial commentaries.

Twenty-two years as prime minister and six years as a retiree have not made him less tired to lambast opponents, question government policies and snub his nose at critics.

So much so, a political commentator has called him the ‘Malay Ultraman’ – which is also a take from the early days of his political career when Mahathir was known as the ‘ultra Malay.’

ultraman-mahahitr.png“Mahathir shows he still wants to interfere in government affairs, proving that Umno and the Barisan Nasional is not free of his dominance.

Mohd Rashid Hasan said while Mahathir is already 84 years old, his politics is like that of a young man.

“Despite his age, Mahathir refuses to stop. He is active as a politician, a blogger and as many other things.

“Lately, he has been more fierce, to even bring up issues of race and Malay supremacy,” Rashid wrote in the PAS newspaper, Harakah Daily.

He added Mahathir seems adamant about reviving his ‘ultra Malay’ role and being the ‘Malay Ultraman’ to supposedly champion the Malay cause.

Mahathir vs Nazri

Rashidi said the former PM’s spat with Minister in the Prime Minister’s Department Nazri Aziz, is not a new occurence as the two had not been on good terms for a number of years – long before PM Mahathir stepped down in October 2003.

“Whatever differences there are between Nazri and (ex-DPM) Anwar Ibrahim, the two can still sit down over a cup of coffee.

Rashidi said the pertinent issue that has surfaced from the Mahathir-Nazri quarrel is whether ‘ultra’ communal, racial and nationalistic sentiments in the country’s politics stll relevant in today’s political scenario.

Also, he questioned, is Umno truly fighting for the survival of the Malays?

Defence without oppression and injustice

Answering his own questions, Rashidi said not one race would sidestep his own race, whether Malay, Chinese, Indian or any other race, and their leaders would want to champion their cause.

However, he added, no one should intentionally oppress or bring injustice to any race.

He said comments by Mahathir that had seemed racist were probably aimed at Umno leaders,  to show that the Malays can no longer rely on the party to defend their cause.

“Take a look at Umno now. Is it still qualified as a champion of the Malays? Is the MCA qualifed to champion the Chinese and the MIC the Indians?

“These three parties, set up to uphold the spirit of nationalism, is no longer accepted and rejected now by the people. – Malaysian Mirror

Whatever he said or criticised to the Government of the day,one must not forget that all those SHIT now is originated from his CORRUPT REGIME era.CORRUPTIONS,MONEY POLITICS,SUPRESSIONS,RACIST POLICY,DESTROYING THE JUDICIARY SYSTEM,MEGA PROJECTS, to name a few has happen since his ADMINSTRATION and now he seems like he want to CHAMPIONED for all those course?What a joke.

‘Anwar tidak tahu pasal ekonomi’

“Bercakap memang pandai tetapi pasal ekonomi dia tidak tahu,” katanya.Dr Mahathir memberitahu pemberita ketika ditanya mengenai pelantikan Anwar sebagai penasihat ekonomi kerajaan Selangor dengan bayaran elaun simbolik RM1 sebulan, lapor Bernama.

Dr Mahathir berkata, semasa menjadi menteri kewangan ketika berlaku krisis kewangan, Anwar telah menerima pakai pendekatan Tabung Kewangan Antarabangsa (IMF) yang memburukkan lagi keadaan di negara ini.

Mengenai bayaran elaun RM1 kepada Anwar, beliau berkata : “Jika kita bayar RM1, maka nilai yang kita dapat adalah RM1.”

Sabtu lalu, Menteri Besar Selangor, Tan Sri Abdul Khalid Ibrahim mengumumkan pelantikan Anwar sebagai penasihat ekonomi negeri itu “dengan elaun tetap sebanyak RM1 sebulan”.Abdul Khalid berkata Anwar akan mengambil peranan penasihat seperti Lee Kuan Yew yang menjadi menteri mentor bagi Singapura.

Menurut menteri besar Selangor itu lagi, pelantikan itu dibuat memandangkan Anwar berpengalaman sebagai menteri kewangan dan juga sebagai pengarah dana dan penasihat sebuah bank Islam terbesar di dunia.

Ianya, kata beliau, selari dengan hasrat negeri itu untuk menjadikan Shah Alam sebagai pusat pelaburan dana Islam.

Apa kes pulak Che Det nie?tak habis-habis nak bantai Anwar,dosa apa lah yang besar sangat sampai Che Det tak habis-habis nak kutuk,hina,aib kan Anwar ni.Di sumbat kan dalam penjara sudah,di pukul sampai lebam biji mata sudah,di belasah sampai retak tulang belakang sudah,di telanjang sudah,di pecat sudah,apa lagi yang belum?Kalau betul tidak tahu pasal ekonomi,yang Che Det pegi lantik dia jadi Menteri Kewangan dulu buat ape?Masa Kegawatan Ekonomi  tahun 97-98 dulu bukan main Che Det kutuk,serang dan salahkan si Yahudi George Soros tu.Penyanggak Matawang lah,Spekulator Matawang lah.Tapi yang dalam gambar nie apesal pulak?siap berjabat mesra lagi tue.tak nak pegi maki,hamun,hina,kutuk dia macam yang Che Det cakap dulu?jew-hater-mahathir-and-nazi-george-soros

Dah pencen sekarang nie,sudah lah,umur pun dah “Senja”,entah besok,entah lusa.Semua “Bau Busuk” yang sekarang nie,Che Det punya pasal lah,pasal dulu,Che Det pakar dalam “TUTUP,MENUTUP” nie,sampai kan Si Linggam tu pun Che Det bagi kuasa nak menentukan Perlantikan Ketua Hakim..Memang betul mcm yang Che Det cakap dulu.“Melayu Mudah Lupa”
